New USPTO Representation Requirements for Foreign Applicants
Effective July 20, 2026, the USPTO requires foreign-domiciled patent applicants and patent owners to be represented by a USPTO-registered patent practitioner. This requirement applies to existing applications as well as new filings, although certain initial filings may still be made without representation.
For foreign inventors who previously prepared and filed their own U.S. patent applications (pro se), this change may require engaging a registered practitioner to continue prosecution. If you have already filed your own application, you may not need to start over. Jong Patent Firm can review your application, identify outstanding issues, address procedural deficiencies where permitted, and help develop a practical strategy for moving forward.
A Client Success Story: Patent Allowance Without an RCE
A foreign inventor engaged Jong Patent Firm after receiving a Final Office Action on a U.S. patent application he had prepared and filed himself. Although his specification and drawings were reasonably well prepared, his claims and subsequent amendments did not fully comply with USPTO requirements. Despite considerable patience and guidance from the Patent Examiner, the inventor was unable to resolve the remaining deficiencies.
After reviewing the prosecution history, we worked directly with the Examiner to address the outstanding issues and brought the application to allowance without filing a Request for Continued Examination (RCE). This avoided the additional RCE filing fee and the prosecution costs and delays that continued examination could have involved.
Pleased with the result, the inventor subsequently entrusted us with a second application that he had also filed himself. For that application, we prepared a petition to correct a priority claim and preliminary amendments addressing deficiencies in the claims and drawings. This experience illustrates how experienced representation can potentially save inventors time and money by resolving problems efficiently and avoiding unnecessary prosecution steps. Results depend on the circumstances of each application, and similar outcomes cannot be guaranteed.

Why Choose Jong Patent Firm?
Experience and Direct Examiner Communication
Our firm’s principal has been a USPTO-registered patent practitioner since 2005, bringing over 20 years of U.S. patent prosecution experience. We understand that obtaining a patent requires more than a technically sound invention. Properly drafted claims, compliant submissions, and effective prosecution strategies can make a substantial difference in the time and expense involved.
We place particular emphasis on communicating directly with Patent Examiners when appropriate. Examiner interviews can help clarify objections, resolve technical misunderstandings, discuss proposed amendments, and identify practical paths toward allowance. Our approach emphasizes efficient problem-solving, avoiding unnecessary rounds of prosecution, and preserving commercially meaningful claim scope.
Native Chinese Communication and Engineering Expertise
Our firm’s principal is a native Chinese speaker and a New York State-licensed Professional Engineer (P.E.). For Chinese-speaking inventors and engineering teams, this combination allows complex technical concepts to be discussed directly in Chinese, reducing potential misunderstandings associated with translation.
Engineering expertise also helps us understand how inventions operate, recognize technical distinctions, and develop clearer disclosures and claim strategies. Chinese-speaking clients benefit from communicating directly with a patent practitioner who understands both their language and their technology.
Cost-Conscious, Fully Remote Representation
We recognize that patent prosecution expenses are an important consideration for inventors and businesses. Our goal is to address procedural deficiencies early, identify practical solutions, and avoid unnecessary prosecution steps whenever possible. Experienced representation can potentially reduce overall prosecution costs by preventing avoidable complications and delays.
Our fully remote practice serves clients internationally through video conferences, electronic document exchange, and direct communication with the practitioner handling their applications. Clients can receive U.S. patent representation without traveling to the United States.
